Trademarks

A trademark consisting of  words, letters or a design can be registered to distinguish goods or services. Canadian trademarks are registered federally. Foreign trademarks are registered in those countries you wish protection.

A trademark should be distinctive.

To obtain a trademark, a search must be made, an application filed with the fee (currently $150). The Trademark Office will review the filing and if it is acceptable advertise your application in the Trademarks Journal. Others have an opportunity to oppose the registration.  If the trademark is not opposed or any opposition is overcome, then the trademark will be registered and a further fee of $200 is payable.

This process can take a year or more to complete.
